KJK Takes Down MAP Violator
Our client, a leading designer, manufacturer and distributor of high quality indoor and outdoor lighting fixtures for home and businesses worldwide, had invested heavily in its products and the protection of its valuable intellectual property. It had established a sophisticated network of loyal, authorized sales representatives, retailers, designers, distributors and resellers. To support this network (all of whom also invested significant time and resources to deliver extraordinary customer experience) and to maintain the value of its brand, our client adopted a Minimum Advertising Price (MAP) Policy.
The Problem
An unauthorized online reseller was selling thousands of our client’s products– and possible counterfeits – in violation of the established MAP Policy and, without our client’s consent, using its registered trademarks and proprietary copyrighted material and images.
How KJK Solved It
Combining the power of the DMCA subpoena, the potential threat of detention and seizure of the offending products by the Intellectual Property Branch of U.S. Customs and Border Control in Washington and substantial damages for trademark and copyright infringement, we quickly closed down the offending reseller who agreed forever to refrain from selling our client’s products or otherwise using its trademarks and copyrighted material.
