Unauthorized sellers. Fake reviews. Counterfeits and knock-offs. These are just some of the threats to your brand.
KJK’s eCommerce Group employs innovative, efficient and cost effective systems to protect companies’ brands and thwart unauthorized resellers.
We establish foundational systems to identify and control the supply chain, protect brand value and eliminate online threats.
Protecting your company’s name, trademarks, trade dress and copyrights is crucial to the creation and development of your brand. KJK has extensive experience in the trademark and trade dress protection and prosecution process, which involves filing trademark applications, responding to office actions issued by the U.S. Patent and Trademark Office (USPTO) and ultimately obtaining a registration from the USPTO. KJK can also assist in maintaining your trademark registrations, as well as in defending your trademarks against those infringing on your rights. With recent changes in the copyright law, registration of your product images and brand descriptions is more critical than ever and KJK can expedite your registration process to enable you to attack violators of your rights.
Combating Unauthorized Resellers
Unauthorized resellers are a menace to legitimate online sellers. On Amazon, eBay and other platforms, unauthorized online resellers confuse buyers, sabotage a company’s brand, post fake reviews, ruin reputation and goodwill, cut into profit margins and disrupt relationships with legitimate authorized resellers. KJK’s eCommerce attorneys establish the foundational systems to identify and control the supply chain, protect brand value and eliminate unauthorized resellers. With the power of the DMCA subpoena to identify unauthorized resellers, and a global network of enforcement partners, we can stop unauthorized online sales, protect your brand and increase your bottom line.
Trademark owners often discover that imposters have created domain names that use their mark in a confusing manner. The registrants of these domain names are attempting to trade on the established goodwill of your mark. This hurts your brand and diverts sales away from your website. Fortunately, this practice is illegal. KJK can assist in transferring or canceling these domain names through the Uniform Domain Name Dispute Resolution Policy (UDRP).
Manufacturers are increasingly implementing Minimum Advertised Price (MAP) policies to protect the company’s brand and to increase competition among the company’s authorized resellers. KJK can assist in creating and implementing a MAP policy that is easy for resellers to understand and follow, adheres to antitrust regulations and avoids price fixing allegations.
Protecting your Domain Name
In an online world, no address is more important than your domain name. Cybersquatting and other trafficking in domain names is a threat to your brand and KJK can help develop procedures and protections to preempt bad actors.
We operate in a global economy, and as a result, there has been an increase in the number of counterfeit goods manufactured in other countries and shipped to the U.S. If your company is being negatively impacted by the import of counterfeit goods, KJK can assist in notifying the U.S. Customs and Border Protection agency to prevent these goods from ever entering the marketplace.
Intellectual Property is both an asset and a tool for building value in your company. We can help you assess, cultivate, and protect the potential of your core technology, brand, and product & service offerings through patent, trademark, copyright, and trade secret protection: identifying creative and cost-effective strategies that are compatible with your business objectives.

eCommerce Case Study
KJK Takes Down MAP Violator
Our client, a leading designer, manufacturer and distributor of high quality indoor and outdoor lighting fixtures for home and businesses worldwide, had invested heavily in its products and the protection of its valuable intellectual property. It had established a sophisticated network of loyal, authorized sales representatives, retailers, designers, distributors and resellers. To support this network (all of whom also invested significant time and resources to deliver extraordinary customer experience) and to maintain the value of its brand, our client adopted a Minimum Advertising Price (MAP) Policy.
An unauthorized online reseller was selling thousands of our client’s products– and possible counterfeits – in violation of the established MAP Policy and, without our client’s consent, using its registered trademarks and proprietary copyrighted material and images.
How KJK Solved It
Combining the power of the DMCA subpoena, the potential threat of detention and seizure of the offending products by the Intellectual Property Branch of U.S. Customs and Border Control in Washington and substantial damages for trademark and copyright infringement, we quickly closed down the offending reseller who agreed forever to refrain from selling our client’s products or otherwise using its trademarks and copyrighted material.
