OVERVIEW & EXPERIENCE
Kyle Podolak advises employers on a broad range of workplace matters as a member of KJK’s Labor & Employment practice group. His practice covers the employment issues that challenge businesses of every size, including hiring and termination decisions, employee discipline, wage and hour compliance and the development of workplace policies.
Kyle counsels clients on their obligations under federal, state and local employment laws, with particular experience in matters involving discrimination, harassment, retaliation, disability accommodation and employee leave. He brings a practical, detail-oriented approach to his work, helping employers understand their legal obligations, anticipate risk and respond effectively as the employment landscape continues to evolve.
Kyle is committed to working closely with clients to develop clear, actionable strategies, whether that means advising on routine compliance questions or navigating more complex workplace challenges.
Representative Experience
- Advised on employment-related issues in a multibillion-dollar merger, addressing compliance and risk for a workforce of more than 5,000 employees.
- Conducted comprehensive on-site investigations across multiple automotive manufacturing facilities nationwide.
- Achieved multiple dismissals of claims for hospitality clients at the administrative level.
- Successfully argued and won motion for attorneys’ fees for client in retaliation case.
- Helped brief the winning arguments in Marietta Memorial Hospital Employee Health Benefit Plan v. DaVita, Inc., where the U.S. Supreme Court delivered a 7–2 victory for the client, reversed the Sixth Circuit, and resolved a national circuit split over the Medicare Secondary Payer Act.
